4. Client Obligations

The Client agrees to:

  • Provide Durbins with accurate and complete information about the property being let.
  • Comply with all relevant legislation related to property rentals in the UK.
  • Maintain the property in a good state of repair throughout the tenancy.
  • Be responsible for all costs associated with the property, excluding those explicitly agreed upon with Durbins.

5. Durbins Obligations

Durbins agrees to:

  • Act with due care and skill in providing the agreed-upon services.
  • Market the property to a suitable audience of potential tenants.
  • Conduct reference checks on prospective tenants in accordance with the law.
  • Prepare a legally compliant tenancy agreement.
  • (Optional, if applicable) Collect rent from the tenant and forward it to the Client after deductions for fees.
  • (Optional, if applicable) Arrange and oversee property inspections and maintenance work.

6. Termination

This Agreement may be terminated by either party with written notice (as outlined in the separate agreement).

7. Disclaimer and Limitation of Liability

Durbins will not be held liable for any loss or damage arising from:

  • The actions or omissions of the Client or the tenant.
  • Circumstances beyond our reasonable control.

8. Dispute Resolution

Any disputes arising from these Terms will be settled through negotiation. If negotiations fail, the dispute will be settled in accordance with the laws of England and Wales.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.

10. Entire Agreement

These Terms constitute the entire agreement between Durbins and the Client regarding the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

11. Amendment

Durbins reserves the right to amend these Terms at any time by posting the revised terms on our website. Your continued use of our website or services following the posting of revised Terms will be deemed your acceptance of the new terms.
